Health and safety law 2015

Chapter 4

Compensation

[ch 4: page 63]

The maximum compensatory award for unfair dismissal is capped at £78,335 (from 6 April 2015), or 52 weeks’ gross pay, whichever is the lower. However, there is no maximum cap in cases of dismissal for health and safety reasons or for whistleblowing. However, in practice, large awards are rare. Ministry of Justice employment tribunal statistics published in September 2014 show that the median (midpoint) compensation award for unfair dismissal was just £5,016 in 2013-14.
