Whistleblowing - a guide to the law

Chapter 3

Homeworkers

[ch 3: page 16]

Homeworkers, such as many freelancers, have whistleblowing protection when they provide services in their own home or anywhere else that is not under the control of the business that contracts out the work to them , even if they provide those services through a service company (section 43K(1)(b), ERA 96). Again, there must be a contract in place. The genuinely self-employed, freely offering services to their own customers and clients on an arms-length basis, are not protected.
