Chapter 13

Schedule of loss

[ch 13: page 460]

Tribunals will expect to see a Schedule of Losses early in the process. This is a document that sets out the claimant’s losses, their basis and how they are calculated. The schedule can be updated as the claim progresses. It is important to be accurate when providing information about losses and to avoid inflated or unrealistic claims. An accurate, realistic assessment, backed up by supporting evidence, can help promote a settlement. An unreasonably inflated claim and a refusal to move from it can lead to an order that the claimant pay some of their employer’s legal costs.
