[ch 13: page 472]Many unions recognise that mediation has a potential role to play in resolving workplace disputes as long as it is clearly voluntary, and as long as refusing mediation does not prevent someone accessing the employment tribunal. In-work mediation aims to resolve disputes while a worker is still employed.
The TUC and Acas have published joint guidance on good practice, Mediation: a guide for trade union representatives, available on the Acas website (www.acas.org.uk/media/pdf/m/7/Acas_TUC_Mediation_Guide_AUGUST_2010_%28Final%29.pdf).
Acas, as a reputable, trusted and impartial organisation, is the TUC’s preferred mediator.
