Victimisation
[ch 4: page 18]Laws protecting people from victimisation under the EA 10 are there to prevent people being deterred from enforcing their rights out of fear of employer retaliation. There is victimisation where someone is subjected to a detriment because they tried to enforce a right under the EA 10, such as asking for reasonable adjustments to help manage a disability at work. Victimisation can take many forms, for example, giving someone a poor reference because they have made a complaint of disability discrimination (Jones v 3M Healthcare EAT/0714/00).
