Where a driver faces dismissal due to the loss of his licence, the employer should first look for suitable alternative employment. However, failing to do this will not always make a dismissal unfair. As always, it depends on context. For example, in Wincanton Group PLC v Gregory [2012] UKEAT/0011/2/1110, Mr Gregory’s dismissal was unfair because Wincanton actively misled him into thinking it was looking for other suitable jobs after he was no longer allowed to drive, when this was not true.
