Pay in lieu of annual leave

The WTR are intended to promote the health and safety of workers and so there is an absolute prohibition on payment in lieu of any part of the statutory annual leave entitlement under the Working Time Regulations. This is designed to avoid employers offering workers payment to forgo their minimum holiday entitlement.
The only exception is where the employment ends, leaving the worker with unused holiday.
