Time limits

The time limit for all discrimination cases is three months from the date of the discriminatory act. The correct way of calculating the three-month period is to take the day of the month immediately before the date of the discriminatory incident that triggered the claim, and then go forward three months. There is more information on time limits in Chapter 13.



The first step in any tribunal claim is to submit an Acas EC Notification Form, available from the Acas website. This step is mandatory and must be taken within the three-month time limit. See Chapter 13 for information about Acas EC.



Members must take great care with time limits. In particular, the three-month time period for bringing a claim continues to run even if the member is still waiting for the results of their grievance and any appeal.
