Time limits

The grievance procedure does not change the time limits for bringing a legal claim in the employment tribunal. In other words, the three-month time limit for bringing a tribunal claim for constructive unfair or discriminatory dismissal runs from the date of dismissal, regardless of whether the grievance procedure has been exhausted by that date. The same is true of any other tribunal claims that are likely to be the subject of a grievance, such as unpaid wages or holiday pay. For more detail see the LRD’s Law at work 2012.
