It is unlawful for an employer or employer’s representative such as a recruitment agency to ask job applicants whether they plan to opt out of pension auto-enrolment, or to suggest that their success could depend on whether they opt out. These rules apply whether or not the employer is already subject to auto-enrolment (see Chapter 4: Pensions Auto-enrolment).
