[ch 7: page 285]Claims of discrimination can be taken against bodies other than employers. Partnerships, trade unions, qualifying bodies, vocational training bodies, employment agencies and statutory bodies are all covered under the legislation.
In Michalak v The General Medical Council & Others [2016] EWCA Civ 172, the EAT ruled that claims for unlawful discrimination under the EA 10 can also be brought in the employment tribunal against regulatory bodies. Michalak brought claims in the employment tribunal for harassment, sex, race and disability discrimination against the GMC, its chief executive and registrar, arising out of the conduct of a “fitness to practice” investigation.
