Following a successful union and media campaign, restaurant and bar employers are no longer able to make up workers’ pay to the NMW using customers’ tips, service charges or gratuities (reg 10(m), NMWR 15).



A government consultation on tipping, calling for an end to unfair tipping practices and greater transparency for customers and staff, closed in June 2016. The government response has not yet been published. Consultation proposals included updating the current voluntary Code of Practice and putting tipping on a statutory footing to increase employer compliance.
