Personal injury claims changes
[ch 2: page 40]The Civil Liability Act 2018 will force more personal injury claims into the small claims court where injured workers cannot recover the costs of legal representation from negligent employers. The Act will allow the small claims limit to increase from £1,000 to £5,000 for most road traffic accident claims and £2,000 for all other personal injury claims.
In February 2020, the government announced it would delay the regulations until 1 August 2020 to allow more time to prepare for the changes, including putting in place changes to the Civil Procedure Rules. Unions are continuing their fight to stop them.
