Selection for redundancy
[ch 7: page 109]Attendance can be used as a basis for redundancy as one of a range of selection criterion. However, “attendance” has a potentially discriminatory impact (because disabled workers and women (who are more likely to have caring responsibilities) are more likely to have poor attendance records), so it must not be used as the only or determining criterion. This is based on Equality and Human Rights Commission guidance on avoiding discrimination while making redundancies.
