Initial consideration

Once the ET1 and ET3 Claim Forms have been successfully submitted, they pass through another administrative stage known as Initial Consideration. This is when an employment judge checks through the Claim and Response. If the judge thinks either the Claim or the Response is unlikely to succeed, they must notify the party affected, instructing them to show cause (i.e. explain) why their claim should be allowed a full hearing, as opposed to being struck out (i.e. dismissed) at this early stage (tribunal rules 26-28). They will be asked to attend a preliminary hearing to do this.
