Chapter 10

Non-renewal of a fixed-term contract

[ch 10: page 347]

The ending and non-renewal of a temporary (fixed-term) contract is a dismissal, and the employee can claim unfair dismissal as long as the other qualifying conditions (for example, as to length of service) are met. It is unlawful to ask employees on fixed-term contracts to waive their right to this protection (Fixed Term Employees (Prevention of Less Favourable Treatment) Regulations 2002).
