Loss of driving licence
[ch 10: pages 365-366]Where a driver faces dismissal because he cannot legally do his job due to the loss of his licence, the employer should first look for suitable alternative employment. However, failing to look for other employment will not always make a dismissal unfair. As always, it depends on the circumstances. For example, in Wincanton Group PLC v Gregory [2012] UKEAT/0011/2/1110, Mr Gregory’s dismissal was unfair because Wincanton actively misled him into thinking it was looking for other suitable jobs for him after he was no longer allowed to drive, when this was not true.
