[ch 6: page 175]The duty to make reasonable adjustments does not apply where the employer does not know, and could not reasonably be expected to know, the individual is disabled (Schedule 8, para 20(1) EA 10). A careful record should be kept of any notification to the employer. The way the law treats the employer’s knowledge in the context of disability is explained on page 152.
