Enforcement of statutory holiday rights
[ch 4: page 133]If an employer refuses to pay for statutory holidays, a worker can bring a tribunal claim. The first step is to submit an Acas Early Conciliation (EC) Notification Form, available from the Acas website. See Chapter 14 for more information.
In its Good Work Plan, published in December 2018, the government has promised to introduce state enforcement of arrears of statutory holiday pay on behalf of vulnerable workers, mirroring the approach to enforcement and penalties already taken to National Minimum Wage recovery, and to set up a new single labour market enforcement agency. Proposals were originally promised for early 2019.
