[ch 4: page 100]Following a successful union and media campaign, restaurant and bar employers are no longer able to make up workers’ pay to the NMW using customers’ tips, service charges or gratuities (reg 10(m), NMWR 15).
In May 2016, the government launched a consultation on tipping, calling for an end to unfair tipping practices and greater transparency for customers and staff. Proposals include updating the current voluntary Code of Practice and putting tipping on a statutory footing to increase employer compliance.
