Who is eligible for Additional Paternity Leave?

To claim Additional Paternity Leave (APL) you must:

• be a father, or the husband, partner or civil partner of the baby’s mother;

• have main responsibility for the child’s upbringing (apart from the mother) and intend to care for the child during APL;

• have 26 weeks’ service, ending the 15th week before the week the baby is due, and remain in employment until the APL is due to start;

• demonstrate to your employer that the mother is entitled to maternity leave, SMP or Maternity Allowance and has returned to work without using up her full entitlement to maternity leave; and

• give notice, following the statutory procedure.
