[ch 5: page 56]Regulation 4 of old TUPE continues to govern future variations to contract terms where the transfer took place before 31 January 2014.
In summary, under Regulation 4(4) of old TUPE, a contract change is void if the sole or principal reason for the variation is either:
• the transfer itself; or
• a reason connected with the transfer that is not an economic, technical or organisational reason entailing changes in the workforce (see page 62).
