Claims for constructive dismissal
[ch 6: page 73]The rule in Regulation 4(9) does not remove an employee’s right to bring a normal claim for constructive dismissal in response to a fundamental breach of the employment contract. Any decision to resign should only ever be the last resort, after taking advice and considering all other available options.
