Transfers on or before 30 January 2014

The 2014 Regulations only affect employees whose employment transfers on or after 31 January 2014. Where a transfer took place on or before 30 January 2014, any term incorporated from a collective agreement will continue to enjoy the same level of protection as any other contract term. Any variation of a collective term incorporated into the employment contract will be void if it is by reason of the transfer, or for a reason connected to the transfer that is not an economic, technical or organisational reason entailing changes in the workforce (see page 72).
