The High Court has stated, in the case of Kidd v Axa Equity & Law Life Assurance Society, that there are only two duties on an employer in relation to the giving of references. These are that they should be accurate in their content and that they should not be misleading. In this case an ex-employee, who claimed that a reference was not sufficiently comprehensive, did not have the claim upheld because there was no such duty on the employer.
